FUTURES ACADEMY — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Futures Academy (the “Service”), including any content, community access, live sessions, mentorship, trade education, charts, messages, voice calls, or other materials provided through Whop, Discord, our website, and any related channels (collectively, the “Platforms”).

By purchasing, joining, accessing, or using Futures Academy, you agree to these Terms. If you do not agree, do not use the Service.

1) IMPORTANT EDUCATIONAL NOTICE (NOT FINANCIAL ADVICE)

Futures Academy is an educational and informational community. We do not provide financial advice and we do not provide individualized investment recommendations.

Nothing in Futures Academy constitutes:

  • Financial, investment, legal, tax, or accounting advice

  • A solicitation, recommendation, or endorsement to buy or sell any security, futures contract, option, crypto asset, or other instrument

  • Personalized advice based on your financial situation, goals, or risk tolerance

You are solely responsible for your trading decisions.

2) RISK DISCLOSURE (FUTURES ARE HIGH RISK)

Trading futures, options, and leveraged products involves substantial risk of loss and is not suitable for everyone. You can lose more than your initial deposit. Past performance, payout screenshots, and testimonials are not indicative of future results. Markets can move quickly and unpredictably.

You agree that you understand these risks before using Futures Academy.

3) NO GUARANTEES / NO PROMISES OF RESULTS

Futures Academy does not guarantee:

  • Profits, payouts, evaluation passes, funded accounts, or any performance results

  • That any trade idea, callout, setup, or strategy will be profitable

  • That you will achieve any specific outcome by following content in the community

Any examples of performance (including payouts or trade outcomes) are shown for education and transparency only. Results vary and depend on many factors including discipline, market conditions, risk management, experience, and account rules.

4) ELIGIBILITY

You must be at least 18 years old (or the age of majority where you live) to use Futures Academy. By using the Service, you represent that you meet this requirement and can legally enter into these Terms.

5) WHAT YOU RECEIVE

Futures Academy may include, without limitation:

  • Educational trade breakdowns, concepts, and training

  • Market commentary and chart-based examples

  • Live sessions and community Q&A

  • “Callouts,” “setups,” or “trade ideas” shared for educational discussion

  • Optional mentorship/coaching and feedback (still educational, not advisory)

We may add, remove, or modify features at any time.

6) YOUR RESPONSIBILITIES

By using Futures Academy, you agree that you will:

  • Use your own judgment and trade at your own risk

  • Follow your own broker/prop-firm rules and read their policies

  • Manage your position sizing and risk (including max loss and risk limits)

  • Understand that “callouts” are not signals and may not fit your situation

  • Not rely solely on Futures Academy to make trading decisions

7) THIRD-PARTY PLATFORMS (WHOP, DISCORD, BROKERS, PROP FIRMS)

Futures Academy relies on third-party services such as Discord and Whop. We do not control these platforms and are not responsible for outages, bans, errors, delays, account locks, data issues, platform policy changes, or service interruptions.

Any references to prop firms, brokers, or platforms are not endorsements unless explicitly stated. You are responsible for verifying rules, fees, and eligibility with those companies.

8) PAYMENTS, SUBSCRIPTIONS, CANCELLATIONS, AND REFUNDS

Payments

Payments are processed through Whop (or other payment processors used by the Platform). By purchasing, you authorize charges consistent with your selected plan (monthly, recurring, or one-time as offered).

Cancellations

If your plan is recurring, you may cancel through the Platform (Whop) at any time. Cancellation stops future billing, but you retain access until the end of the current paid billing period, unless terminated earlier under these Terms.

Refund Policy (Professional + protective)

All sales are final. No refunds are provided, except where required by applicable law.
We do not offer refunds for:

  • Lack of profitability or performance

  • Inability to follow rules

  • Missed streams/callouts

  • Platform issues outside our control (Discord/Whop outages)

  • Changed mind / no longer wanting access

Chargebacks / Disputes

Chargebacks or payment disputes may result in immediate removal from Futures Academy and revocation of access. We reserve the right to dispute chargebacks with evidence of access and delivery.

9) COMMUNITY RULES AND CONDUCT

To maintain a professional environment, you agree that you will not:

  • Harass, threaten, doxx, stalk, or intimidate others

  • Post illegal content or promote illegal activity

  • Share hate speech, discrimination, or targeted abuse

  • Spam, scam, or post deceptive marketing

  • Impersonate Futures Academy owners/moderators or misrepresent results

  • Post or encourage “guaranteed” outcomes, payouts, or eval passing

  • Share, resell, distribute, or provide access to paid content to non-members

  • Record, screen-capture, or redistribute private calls/content without permission

We can remove content, restrict access, mute, or ban members at our discretion to protect the community.

10) INTELLECTUAL PROPERTY / NO REDISTRIBUTION

All Futures Academy materials—including lessons, templates, PDFs, videos, recordings, text, graphics, charts, branding, and community content created by Futures Academy—are protected intellectual property.

You may not:

  • Copy, resell, redistribute, publish, or commercially use our content

  • Share content outside the paid community

  • Create derivative products from our materials without written permission

Violation may result in termination and potential legal action.

11) NO RECORDING / NO CONTENT LEAKS

You agree not to record, reproduce, stream, or distribute any part of Futures Academy (including voice calls, live sessions, chats, and mentorship) without explicit written permission from Futures Academy.

12) TERMINATION OF ACCESS

We may suspend or terminate your access without notice if:

  • You violate these Terms or community rules

  • You engage in chargebacks, fraud, harassment, or content sharing

  • Your conduct creates legal, compliance, or safety risk

  • We determine removal is necessary to protect the community or business

Termination does not entitle you to a refund unless required by law.

13) DISCLAIMERS

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURES ACADEMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee accuracy, completeness, timeliness, or availability of any content or communications.

14) LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURES ACADEMY (INCLUDING OWNERS, MODERATORS, AND AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, TRADING LOSSES, OR OPPORTUNITY—EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO ACCESS FUTURES ACADEMY IN THE LAST 30 DAYS, OR $100, WHICHEVER IS GREATER.

15) INDEMNIFICATION

You agree to indemnify and hold harmless Futures Academy, its owners, moderators, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

  • Your use of the Service

  • Your trading activity or results

  • Your violation of these Terms

  • Your content or conduct on the Platforms

16) DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER

Informal Resolution First

Before starting any formal action, you agree to contact Futures Academy through Whop support messaging or the Discord ticket/support system and attempt to resolve the issue informally.

Binding Arbitration (Illinois)

If a dispute is not resolved informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.

  • Arbitration Location: Cook County, Illinois (or remote/virtual if permitted)

  • Language: English

  • No Class Actions: You agree to bring claims only in your individual capacity and waive any right to participate in a class action, collective action, or representative proceeding.

Nothing prevents either party from seeking relief in small claims court for eligible matters in Illinois.

17) GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. If a court action is permitted (for example, small claims), venue will be in Cook County, Illinois, unless otherwise required by law.

18) CHANGES TO THESE TERMS

We may update these Terms at any time. Updated Terms are effective when posted on the Platform(s). Continued use of Futures Academy after changes means you accept the updated Terms.
